Changes Coming to Social Security Disability? Attorney Jonathan Ginsberg Says “Get Ready”

Big changes are coming to the Social Security disability program. By now you have heard that SSDI is running out of money, and automatic cuts will go into effect in 2016 unless Congress acts.

While no one expects Congress to turn its back on disabled citizens (we hope), there is growing bi-partisan support for changes to the way Social Security disability conducts its business.

In September, 2012, Oklahoma Senator Tom Coburn released a comprehensive report about the nation’s debt crisis. Included in this report was a section entitled “Social Security Disability Programs: Improving the Quality of Benefit Award Decisions.” In this report, Senator Coburn looked at 300 random decisions from various hearing offices throughout the country. He identified a number of specific concerns about mistakes and misinterpretation of the law by Social Security judges.

Senator Coburn offers several recommendations designed to reduce the number of disability benefit awards. These recommendations include:
-participation of a representative from the government at hearings to oppose claims
-increase the number of reviews of hearing decisions and judges
-reduce judicial discretion and focus more on the listings
-require more conclusions from consultative examination providers
-modify the “grid rules”

After reviewing Senator Coburn’s report, I can say with certainty that his proposals are designed to reduce the number of approved Social Security disability claims.

On the positive side, the Social Security disability process will become more predictable in terms of evidence needed if Senator Coburn’s recommendations are adopted.

Senator Coburn’s proposals have not been formally adopted by Social Security but given SSA’s money crunch, I predict that at least some of his ideas will become part of the SSDI landscape.

Common Car Accidents

Hearing news about car accidents almost every day is not commonplace. They can be avoided but it’s impossible to get rid of them unless people stop using cars. Knowing common car accidents is important for all car owners. It makes them prepared in worst case scenarios. Here are some of the most common car accidents.

Fender-Benders Car Accidents: You probably have heard about this one. This accident is called fender-bender because it is the fender that receives the most damage from collision. Fender-benders occur because of several reasons which have something to do with inattentive drivers. You’re likely to be in this kind of accident if you suddenly stop in a middle of intersection, or if you hit the brake too fast or too slow in a traffic jam.

Runoff Accident: This is a type of accident where cars literally run off the road to avoid hitting something like a paddling of ducklings crossing the road. Sudden turns also cause runoffs.

Side-Impact Accidents: This is an accident where a car hits the other side of another car. Yes, the name itself implies its meaning. “T-boning” is one cause of this accident. T-boning happens when two cars—one going vertical, the other horizontal—bump with each other. Auto dismantlers usually still get a lot of good car parts from cars involved in this kind of accident.

Head-On Accidents: As what was implied by the name, it is an accident where two vehicles collide with each other head to head. It’s like bumper to bumper but worse. This accident commonly occurs due to, as usual, a driver’s negligence like entering a freeway from the wrong direction. Auto dismantlers benefit more from these accidents because repairing cars from these are costly which makes selling the car parts more practical.

The Rollover Accident: Among all the accidents, this one appears to be more interesting because of its name. It’s like a circus ride, isn’t it?
